- how are you are bound by the agreed permitted use to characterising a Lease as retail or non-retail; and
- what the considerations are when the use of the premises is part retail and part non-retail?
We will take you through what you need to know as a leasing agent, Landlord or Tenant where the use of the Premises may fluctuate between what is intended in the negotiations and what the actual use then is.
We will also address the consequences of “permitted use creep” that may lead to future disputes.
